Terms of Service

1. Company Information

ZatpatCRM is a product of Accuspeed Solutions Private Limited, with its registered office at C1501, 15th Floor, Amezon Park, Eksar Road, Near Eksar Metro Station, Borivali West, Mumbai 400091, Maharashtra, India. These Terms of Service govern your access to and use of the ZatpatCRM platform available at zatpatcrm.com.

2. Description of Services

ZatpatCRM is a SaaS-based WhatsApp CRM and business automation platform that provides the following services to businesses:

• Centralized WhatsApp inbox for managing customer conversations
• AI-powered sales and support automation agents
• No-code Visual Flow Builder for building messaging workflows
• Mass broadcast campaigns to opted-in contact lists
• Team collaboration tools with role-based access control
• Integration with WhatsApp Business API (WABA) and WhatsApp Web
• Contact management and CRM pipeline features

Our services are offered on a subscription basis with Free and Paid plans as described on our pricing page.

3. Eligibility & Acceptance

By registering and using ZatpatCRM, you confirm that:

• You are at least 18 years of age
• You have the legal capacity and authority to enter into this agreement on behalf of yourself or your business
• All information provided during registration is accurate and complete
• You agree to comply with these Terms and all applicable Indian laws and regulations

4. Subscription Plans & Pricing

ZatpatCRM offers the following subscription plans:

• Free Plan: 1 user, 1 WhatsApp connection, up to 1,000 contacts — at no charge
• Paid Plans: Additional users, connections, and contacts as per the plan selected at checkout

All prices are displayed on the pricing page and are subject to applicable taxes including GST as per Indian tax laws. Accuspeed Solutions Private Limited reserves the right to modify pricing with 30 days prior notice to existing subscribers.

5. Payment Terms

All payments on ZatpatCRM are processed securely through Razorpay, a payment gateway licensed and regulated in India. By making a payment, you authorize Accuspeed Solutions Private Limited to charge your selected payment method (credit card, debit card, UPI, net banking, or wallet) for the subscription amount.

• Payments are due at the beginning of each billing cycle
• All transactions are encrypted and processed in compliance with PCI-DSS standards
• Accuspeed Solutions Private Limited does not store your card or banking details — these are managed securely by Razorpay
• In case of payment failure, access to paid features may be suspended until payment is successfully completed
• Invoices and payment receipts will be sent to your registered email address

6. Refund & Cancellation Policy

We offer a 7-day free trial on paid plans. No credit card is required for the trial period. After the trial:

• Subscription fees are non-refundable once a billing cycle has commenced
• You may cancel your subscription at any time from your account settings; cancellation takes effect at the end of the current billing cycle
• In case of a technical error or duplicate charge, refunds will be processed within 5–7 business days to the original payment method
• Refund requests must be submitted to info@zatpatcrm.com within 48 hours of the charge

7. WhatsApp & Meta Platform Compliance

ZatpatCRM integrates with WhatsApp via the official WhatsApp Business API and WhatsApp Web. Users must comply with:

• WhatsApp Business Policy and Meta Platform Terms
• Obtaining proper opt-in consent from contacts before sending messages
• Not sending spam, unsolicited bulk messages, or prohibited content
• All applicable Indian laws including the Information Technology Act, 2000 and TRAI regulations

Accuspeed Solutions Private Limited is not liable for WhatsApp account suspensions or bans resulting from user violations of Meta's policies. Users bear full responsibility for the content of messages sent through the platform.

8. User Obligations & Prohibited Use

You agree NOT to use ZatpatCRM for:

• Sending spam, phishing, or fraudulent messages
• Harassment, abuse, or illegal communication of any kind
• Circumventing WhatsApp or Meta's platform restrictions
• Reselling or sublicensing the platform without written authorization
• Any activity that violates Indian law or international regulations

Violation of these obligations may result in immediate account termination without refund.

9. Data Privacy & Security

Accuspeed Solutions Private Limited is committed to protecting your data. Key commitments:

• We do not sell your data or your customers' data to any third party
• All data is stored on secure servers with industry-standard encryption
• Your CRM contact data remains your property at all times
• We retain data only as long as necessary to provide our services

10. Intellectual Property

All intellectual property rights in ZatpatCRM — including the platform, software, design, trademarks, and content — are the exclusive property of Accuspeed Solutions Private Limited. You are granted a limited, non-exclusive, non-transferable license to use the platform solely for your authorized business purposes. You may not copy, modify, reverse-engineer, or redistribute any part of our platform.

11. Service Availability & Disclaimer

We strive to maintain 99.9% uptime for ZatpatCRM. However, Accuspeed Solutions Private Limited does not guarantee uninterrupted or error-free service. We are not liable for downtime caused by third-party services (including WhatsApp, Meta, Razorpay, or hosting providers), force majeure events, or scheduled maintenance.

12. Limitation of Liability

To the fullest extent permitted under applicable law, Accuspeed Solutions Private Limited shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of ZatpatCRM, including but not limited to loss of business, revenue, data, or goodwill. Our maximum aggregate liability shall not exceed the total amount paid by you in the three months preceding the claim.

13. Termination

Accuspeed Solutions Private Limited reserves the right to suspend or permanently terminate your account with or without prior notice in case of:

• Violation of these Terms of Service
• Non-payment of subscription fees
• Fraudulent, abusive, or illegal activity on the platform

You may terminate your account at any time by writing to info@zatpatcrm.com. Upon termination, your data will be retained for 30 days before permanent deletion.

14. Amendments

Accuspeed Solutions Private Limited reserves the right to update or modify these Terms at any time. Changes will be communicated via email or a notice on our website at least 7 days before taking effect. Continued use of ZatpatCRM after such notice constitutes your acceptance of the revised Terms.

15. Governing Law & Dispute Resolution

These Terms of Service are governed by the laws of India. Any disputes arising out of or in connection with these Terms shall first be attempted to be resolved through mutual negotiation. If unresolved, disputes shall be subject to the exclusive jurisdiction of the competent courts in Mumbai, Maharashtra, India.
